Introduction: These are the terms and conditions that apply when you book a Cycling Holiday and associated services from Never Just A Ride S.L.

To ensure complete transparency and mutual understanding between both parties (Never Just A Ride SL, its agents and the booking party)

What is Included within the quoted cost of the Cycling holiday:

• Accommodation: According to your choice of 4* or 5* Hotel (Javea / Xabia-based unless expressively agreed); or self-catering independent Villa (Javea / Xabia-based) or stay with Never Just A Ride Cycling Holiday hosts.
• Board: According to your choice - Breakfast only, Breakfast & evening meal or Self-catering.
• Spanish Airport Transfers: For you (& your bike if required, where Bike Hire through Never Just A Ride has expressively been deselected) – collection and return transfer from Alicante-Elche Miguel Hernandez airport to / from your stay location base in Javea / Xabia.

N.B. Should you require airport transfers from Valancia Airport, this can also be arranged, but is subject to additional charges.

• Bike Hire – Choice of a top-quality carbon road bike (See Bike Hire specific terms).
• Daily guided Rides: We operate on a “no-one is left behind basis” for our rides and whatever the terrain, we aim to keep your holiday group together as much as possible on each ride.
• Daily Ride briefings: Either in the evening prior to each ride, or immediately before we set off, a detailed route briefing is provided.
• Welcome Pack: with souvenir gifts, and ride nutrition aids to get you going on initial rides.
• Never Just A Ride cycling jersey – Never Just A ride partner with an internationally recognised top quality cycling apparel brand. 
• Bike Storage: Secure bike storage will be available either at your stay location or at Never Just A Ride premises.
• Roadside Assistance – should you require emergency assistance during your ride, a collection / pick-up service is available.
• Mechanical Support – should you require any mechanical support / changes to your bike during your stay. 
• 24/7 Support – Someone from Never Just A Ride will always be available to assist you.

What is NOT included, or where offered will be subject to additional charges:

• Your UK Airport transfers 
• Your Flights and luggage costs
• Your Travel Insurance
• Any additional food and drinks outside of your selected Accommodation and Board options
• Access to massage (at additional cost), restricted hotel pools, spa’s & fitness rooms etc.
• Oh…And yes….Your spending money!

By confirming the reservation through payment of the initial deposit, the customer has read, understood and agreed to the terms and conditions set forth below. We reserve the right to amend these terms and conditions at any time and you should therefore check them each time you make a reservation. The terms and conditions applying to your reservation will be those in place on the date that you make your reservation. 

Payment & Customer Cancellation Policy: Please check that the details of your reservation are complete and accurate before you confirm your reservation. We will not be held liable if the order details are incorrect. 

A 50% deposit is required at the time of booking and is non-refundable. Customers can cancel up to 8 weeks before arrival, but the deposit will not be refunded. The remaining balance is due 8 weeks prior to arrival. 

 It is in customers' own best interest to have travel insurance that covers cancellations due to illness, bereavement, or other unforeseen circumstances. 

BICYCLE RENTALS: The customer will be required to sign acceptance upon receiving the bicycle. This is to ensure that the bicycle and equipment are used properly and to ensure that the individual user of the bicycle and equipment behaves responsibly, abides by Spanish road law, and is aimed at ensuring the customer has the best possible experience. Termination: Either party may terminate the bicycle rental agreement at any time by giving written notice to the other party. In the event of termination, the customer shall immediately return the bicycle(s) to Never Just A Ride SL. 

Rental Fees: The cost of the Bike hire is included within the costs of your holiday. Only additional charges for accessories, if any and requested and as mutually agreed will be payable at the time of the rental. 

Damages, Loss & Theft: The customer is responsible for the bicycle, accessories and any third-party property during the period of hire. The customer should not leave the bike unattended, and it should be secured overnight. The customer is responsible for all damages, loss and theft to the bicycle(s), accessories and any third-party property. This includes all costs of repair or replacement. Any damage, loss or theft should be immediately reported to Never Just A Ride SL.  Our Accidental Damage Insurance covers any damage sustained by the bicycle during the hire period. Please note that this insurance does not cover loss or theft of the bicycle. Replacement inner tubes are not included. Additionally, using the bicycle for the prohibited activities outlined below in “Use of Bicycle” will invalidate the insurance coverage. 

Bicycle: The customer is responsible for selecting their bicycle size. Size guides are published on the Cervélo website. There is a €15 charge to swap a bicycle, if the wrong size was booked and the new requested size in the same model is available. If the new bicycle is a more expensive model the price difference will also be chargeable. The bicycle(s), where requested, will have the basic saddle height adjusted at the point of delivery / pick up to best fit the customer. However, we will not guarantee the bicycle geometry will exactly match that of the customer's "bike fit" measurements, nor will we accept any liability for injuries resulting from an incorrect bicycle position. If the customer decides to bring their own saddle they should check compatibility. We may be able to assist with mounting a customer´s saddle at the point of bike handover, though this is not guaranteed. Whilst every effort will be made to allocate the bicycle ordered, on rare occasions - often due to events outside of our control - this may not be possible. If we are unable to offer you another bicycle in the same price bracket or higher you will be refunded any difference in price. In the event we need to cancel your order we will offer you a full refund. The customer accepts the bicycle(s) in working order at the time of rental. If any mechanical issues arise during the rental period, it is the customer’s responsibility to report this as soon as practically possible to Never Just A Ride SL. Where practically and reasonably possible, mechanical issues will be resolved. Please note that charges may apply.

 Use of Bicycle(s): The customer shall be 18 years or older and use the bicycle(s) only for lawful purposes and obey all traffic laws and regulations. The customer shall not use the bicycle(s) for any race, contest, or exhibition unless permission is granted. Off-road cycling is prohibited. The customer shall not remove any parts from the bicycle(s) or make any alterations without consent of Never Just A Ride. The customer shall not permit any other person to use the bicycle(s) except as authorized. Bicycles may not be sub-rented. Do not transport the bicycle by car without prior approval. 

Return of Bicycle(s): The customer shall return the bicycle(s) to Never Just A RIde in the same condition as when rented, with reasonable wear and tear accepted. As noted above, the customer shall be responsible for all costs of replacement if the bicycle(s) and / or accessories are returned in a damaged condition or lost condition which falls outside the Accidental damage cover offered within the cost of the holiday.

Emergency Bicycle Assistance: Never Just A Ride undertake reasonable endeavours to respond to and attend to emergency callouts when the bicycle is being used on the road as part of a guided cycling holiday route ride. 

AIRPORT TRANSFERS: A refund will be processed in the event of cancellation by the transfer company. 

STATEMENT and ASSUMPTION of RISKS and LIABILITY WAIVER : By booking, undertaking and participating in a Cycling Holiday with Never Just A Ride SL, the customer accepts and agrees as follows;

1. Acknowledgement of Risk

• I understand and acknowledge that road cycling is an inherently hazardous activity which involves significant risks, including but not limited to:
  • Collisions with motor vehicles, cyclists, pedestrians, or obstacles
  • Road surface hazards (gravel, potholes, wet surfaces, debris)
  • Mechanical failure of equipment
  • Sudden changes in weather conditions
  • Physical exertion, dehydration, heat exhaustion, or medical events
  • Falls causing serious injury, permanent disability, or death
• I confirm that I voluntarily choose to participate in this activity with full knowledge of these risks.

2. Fitness and Equipment

I declare that:

• I am physically fit and medically capable of participating in this cycling activity.
• I accept that my bicycle and equipment are in safe and roadworthy condition.
• I will wear an approved cycling helmet at all times when cycling on a Never Just A Ride cycling holiday.
• I will comply with all applicable Spanish traffic laws and regulations.

3. Assumption of Responsibility

• I understand that I am solely responsible for:
  • My riding decisions
  • My speed and positioning within a group
  • My compliance with traffic laws
  • The condition of my bicycle and equipment
  • I acknowledge that the Organizer (Never Just A Ride SL, its Directors, staff and agents) is providing guidance only and is not responsible for individual rider conduct or decisions.

4. Release and Waiver of Liability

To the fullest extent permitted by law, I hereby release and hold harmless:

Never Just A Ride SL, its Directors, employees, guides, contractors, and representatives from any and all claims, liabilities, damages, losses, or expenses arising out of or related to:

• Personal injury
• Property damage
• Loss of equipment
• Death

occurring during or as a result of participation in a Never Just A Ride SL Cycling Holiday, except in cases of gross negligence or wilful misconduct by the Organizer.

5. Emergency Medical Treatment

I authorise Never Just A Ride SL (its Directors, staff, contractors and guides) to obtain emergency medical treatment on my behalf if necessary and accept responsibility for any associated costs.

6. Indemnity

I agree to hold harmless Never Just A Ride SL (its Directors, employees, guides, contractors, and representatives) from any claims brought by third parties arising from my actions whilst on a Never Just a Ride SL Cycling Holiday.

7. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of Spain.

This agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, and agreements, whether written or verbal. This agreement may not be modified except in writing signed by both parties.
