Terms and Conditions

These terms and conditions apply when you book a cycling holiday and associated services from Never Just a Ride SL. They are intended to ensure transparency and mutual understanding between Never Just a Ride SL, its agents and the booking party.

What is included in the quoted cycling holiday cost

• Accommodation: According to your choice of a four- or five-star hotel in Jávea/Xàbia (unless expressly agreed otherwise), a self-catering independent villa in Jávea/Xàbia, or a stay with the Never Just a Ride cycling holiday hosts.
• Board: According to your choice: breakfast only, breakfast and evening meal, or self-catering.
• Spanish airport transfers: Collection and return transfer for you and, where required, your bicycle from Alicante-Elche Miguel Hernández Airport to and from your stay location in Jávea/Xàbia. Transfers from Valencia Airport can also be arranged, subject to additional charges.
• Bicycle hire: A choice of a high-quality carbon road bicycle, subject to the bicycle-hire terms below.
• Daily guided rides: We operate on a “no one is left behind” basis and aim to keep the holiday group together as much as possible, whatever the terrain.
• Daily ride briefings: A detailed route briefing is provided either on the evening before the ride or immediately before departure.
• Welcome pack: Souvenir gifts and ride nutrition products to help you get started on the first rides.
• Never Just a Ride cycling jersey: Produced with an internationally recognised, high-quality cycling apparel brand.
• Bicycle storage: Secure bicycle storage at your accommodation or at Never Just a Ride premises.
• Roadside assistance: An emergency collection or pick-up service if required during a ride.
• Mechanical support: Assistance with mechanical issues or changes to your bicycle during the stay.
• 24/7 support: A member of the Never Just a Ride team will be available to assist you.

What is not included

The following are not included, or will be subject to an additional charge where offered:

• Transfers to or from your departure airport in your home country.
• Flights and luggage charges.
• Travel insurance.
• Food and drinks outside your selected accommodation and board options.
• Massage services and access to restricted hotel pools, spas or fitness rooms.
• Personal spending money.

Booking, payment and cancellation

By confirming a reservation through payment of the initial deposit, the customer confirms that they have read, understood and agreed to these terms and conditions. We reserve the right to amend these terms and conditions. The version applying to a reservation will be the version in force on the date the reservation is made.

Please check that the reservation details are complete and accurate before confirming. Never Just a Ride SL will not be held liable where information supplied by the customer is incorrect.

A 50% deposit is required at the time of booking and is non-refundable. Customers may cancel up to eight weeks before arrival, but the deposit will not be refunded. The remaining balance is due eight weeks before arrival.

Customers are strongly advised to obtain travel insurance covering cancellation due to illness, bereavement and other unforeseen circumstances.

Bicycle rental terms

Acceptance and termination

The customer will be required to sign an acceptance form when receiving the bicycle. This confirms that the bicycle and equipment will be used properly, that the rider will behave responsibly and comply with Spanish road law, and that the bicycle has been received in working order. Either party may terminate the bicycle rental agreement by giving written notice. On termination, the customer must immediately return the bicycle or bicycles to Never Just a Ride SL.

Rental fees

The cost of bicycle hire is included within the holiday cost where stated in the confirmed booking. Additional accessories requested and mutually agreed may be charged separately.

Damage, loss and theft

The customer is responsible for the bicycle, accessories and any third-party property during the hire period. The bicycle should not be left unattended and must be secured overnight. The customer is responsible for the cost of damage, loss or theft involving the bicycle, accessories or third-party property, including repair or replacement costs. Any incident must be reported to Never Just a Ride SL immediately.

Accidental damage insurance covers damage sustained by the bicycle during the hire period, but does not cover loss or theft. Replacement inner tubes are not included. Insurance cover is invalidated if the bicycle is used for any prohibited activity described under “Use of bicycles”.

Bicycle selection and fit

The customer is responsible for selecting the appropriate bicycle size. Size guides are available on the relevant manufacturer’s website. A €15 charge applies if the wrong size was booked and another bicycle in the same model and requested size is available. Where the replacement is a more expensive model, the price difference will also be charged.

Where requested, the basic saddle height will be adjusted at delivery or collection. Never Just a Ride SL cannot guarantee that bicycle geometry will exactly match the customer’s personal bike-fit measurements and accepts no liability for injury resulting from an incorrect riding position. Customers bringing their own saddle are responsible for checking compatibility. Assistance with fitting a customer’s saddle may be possible but is not guaranteed.

Every effort will be made to supply the bicycle ordered. Where this is not possible for reasons outside our control, an alternative in the same or a higher price category may be offered. If only a lower-priced bicycle is available, the difference will be refunded. If the order must be cancelled by us, a full refund will be offered.

Mechanical issues arising during the rental must be reported as soon as reasonably possible. We will use reasonable efforts to resolve them. Charges may apply where appropriate.

Use of bicycles

The customer must be at least 18 years old, use the bicycle only for lawful purposes and comply with all traffic laws and regulations. The bicycle must not be used for a race, contest or exhibition without prior permission. Off-road use is prohibited. No parts may be removed and no alterations may be made without consent. The bicycle may not be used by an unauthorised person, sub-rented or transported by car without prior approval.

Return of bicycles

The bicycle and accessories must be returned in the same condition in which they were rented, allowing for reasonable wear and tear. The customer is responsible for replacement or repair costs where damage or loss falls outside the accidental-damage cover included with the holiday.

Emergency bicycle assistance

Never Just a Ride SL will use reasonable efforts to respond to emergency call-outs when a bicycle is being used on the road as part of a guided cycling holiday route.

Airport transfers

If a transfer is cancelled by the transfer provider, any applicable refund will be processed.

Statement and assumption of risk and liability waiver

By booking, undertaking and participating in a cycling holiday with Never Just a Ride SL, the customer accepts and agrees to the following.

1. Acknowledgement of risk

Road cycling is an inherently hazardous activity involving significant risks, including:

• Collisions with motor vehicles, cyclists, pedestrians or obstacles.
• Road-surface hazards such as gravel, potholes, wet surfaces or debris.
• Mechanical failure of equipment.
• Sudden changes in weather conditions.
• Physical exertion, dehydration, heat exhaustion or medical events.
• Falls causing serious injury, permanent disability or death.

The customer voluntarily chooses to participate with full knowledge of these risks.

2. Fitness and equipment

The customer declares that they are physically fit and medically capable of participating, that their bicycle and equipment are safe and roadworthy, that they will wear an approved cycling helmet at all times, and that they will comply with applicable Spanish traffic laws and regulations.

3. Assumption of responsibility

The customer is solely responsible for their riding decisions, speed, group positioning, compliance with traffic laws and the condition of their bicycle and equipment. Never Just a Ride SL, its directors, staff and agents provide guidance only and are not responsible for an individual rider’s conduct or decisions.

4. Release and waiver of liability

To the fullest extent permitted by law, the customer releases and holds harmless Never Just a Ride SL, its directors, employees, guides, contractors and representatives from claims, liabilities, damages, losses or expenses arising from personal injury, property damage, loss of equipment or death during or resulting from participation in a cycling holiday, except in cases of gross negligence or wilful misconduct by the organiser.

5. Emergency medical treatment

The customer authorises Never Just a Ride SL, its directors, staff, contractors and guides to obtain emergency medical treatment on their behalf where necessary and accepts responsibility for any associated costs.

6. Indemnity

The customer agrees to hold harmless Never Just a Ride SL, its directors, employees, guides, contractors and representatives from claims brought by third parties arising from the customer’s actions during a cycling holiday.

7. Governing law

These terms are governed by and interpreted in accordance with the laws of Spain.

These terms constitute the entire agreement between the parties and supersede prior negotiations, representations and agreements, whether written or verbal. They may only be modified in writing and signed by both parties.
